DANIEL TOWN PLANNING

18 June 2014

A Quorum is present: Chairman Eric Bunker, Commissioner Gary Weight, Commissioner Kim Norris, Commissioner Jaye Binkerd, and Commissioner Pam Skinner. Commissioner Blaine Smith arrived at 8:10 p.m.,

Ryan Taylor of Epic Engineering is present.

Chairman Bunker called the meeting to order at 7:04: p.m.

Members of the public in attendance: Carl Berg, Lynne Shindurling, Nephi Trunnell, and Mike Peterson

1- Public comment for any item of concern from the public not listed in the agenda

There were no public comments.

2- Mike Peterson: Hwy 40 and approx. 3200 south (future development review)

Ryan of Epic Engineering presented the commercial concept plan that Mike Peterson had created. The Commissioners were shown the original layout plan Mike had created in 2008. Ryan explained that a few differences between the original plan and the current plan are some property adjustments and more parking spaces added. The parking lights can be set on a timer. The fencing plan is set for six foot privacy fencing along the residential sections and around the garbage area. He already has UDOT’s approval for entry and exit off highway 40. Mike has been asked to read and stick to the town code: 8:10:02:3.

Commissioner Norris moved to approve the Preliminary Concept Plan for the Daniel Plaza pending further architectural concerns for parking and lighting as per town code 8:10:10 including recommendations made in Epic Engineering’s letter dated 16 June 2014, items one through four. Commissioner Weight seconded the motion. Discussion: What about UDOT’s approval letter? The motion is amended to include UDOT’s letter of approval on entrance to property off Highway 40. First and second motion stands. The vote is unanimous and the motion carried.

3- Nephi Trunnell: Hwy 40 and approx. 3400 south (future development review)

Carl Berg of Berg Engineering presented a plan for future development by Nephi Trunnell. Lindsey Parker has approved shared access and UDOT approval has already been obtained. They are looking for any comments concerning what is needed for a preliminary approval in future meeting. The Commissioners looked over the preliminary drawings. Commissioner Binkerd is worried about access to the development from Little Sweden road. Nephi explained that would only be a limited use access.

Commissioner Weight moved to approve the preliminary concept plan of the Trunnell Commercial Park: Phase 1 which includes two buildings on adjacent lots off Little Sweden road being subject to town code 8:10:10 and appropriate application submitted to the Town Council for approval with Commissioner Binkerd seconding. The vote was unanimous and the motions carried.

4- Council actions report: Report on action items that the Town council has or will be considering

The Council is moving forward with resurfacing some of the roads: Daniel Rd, Mill Rd, and part of South Field Rd. HL&P talked to the Town Council about a rate increase. They received a couple more business applications. The Council was informed that Daniel Academy has reapplied for their license and has also opened another school in Heber. They have requested their own Blue Stake indicator. The Council is considering hiring one, full time person as a Public Works employee. They have discussed the tracking, authorization and collection of impact fees. They adopted the two letters submitted concerning Agricultural Building requirements and Temporary Land Use letter. They are now part of applications process.

5- Daniel Town Planning Director Report

There were some issues between property owners and the town right-of-way. Some trees were in that right-of-way and needed to be removed.

Commissioner Weight suggested that in future owners need to be able to verify septic system locations on properties purchased for development and included on future building plans. This will help solve the problem of possible overlapping septic systems on smaller lots. Overlapping systems could invalidate having a buildable lot.

The Bennett’s home in Big Hollow has blocked the culvert. Ryan will check into that.

Commissioner Skinner commented that a neighbor across the street from her on Ranch Drive has brought in and placed a large outbuilding on his property. If the building is 200 feet square or less a building permit is not required. Check town code 8.21.29.

6- Approval of minutes from 19 Mar 2014

Commissioner Weight moved to approve the minutes of 19 March 2014 with Commissioner Binkerd seconding. The vote was unanimous and the motion carried.

7- Motion to adjourn.

Commissioner Binkerd moved to adjourn the meeting with Commissioner Skinner seconding. The vote was unanimous and the motion carried.
