Special Daniel Town Council Meeting

Quorum present: Council members Mayor Michael Duggin, Council members Eric Bunker, Kasey Bateman, and Chip Turner were present at 8:12 PM when Mayor Michael Duggin called the meeting to order. Council member Jon Blotter was absent. Recorder Merry Duggin was present to record the minutes.
Members of the public in attendance: John Glodowski, Gary Weight and Gary Walton.
1) PUBLIC COMMENT CONCERNING ANY ISSUE NOT ON THE AGENDA
There was no public comment.
2) BUSINESS LICENSE APPLICANTS
There were no business license applicants.
3) APPROVAL OF MINUTES FOR AUGUST 5, 2013
This item was continued from the last meeting as the quorum was not sufficient for approval of the minutes. Council member Bunker moved to approve the minutes as presented. The motion, seconded by Council member Bateman passed with the following vote: Bunker, aye; Bateman, aye; Turner, aye; Mayor Duggin abstained because he was absent from the August 5 meeting.
APPROVAL OF MINUTES FOR SEPTEMBER 9, 2013
Council member Turner moved to approve the minutes as presented. Council member Bunker seconded the motion, and the motion passed with Mayor Duggin and Council members Turner and Bunker voting aye. Council member Bateman abstained because he was not present at this meeting on September 9.
4) DISCUSSION AND POSSIBLE ACTION REGARDING DANIELS ACADEMY’S REASONABLE ACCOMMODATION GRANTED IN FEBRUARY 2012
The reasonable accommodation granted to Justin and Janet Robinson in 2012 when they were the administrators of the program at Daniels Academy was specifically written to be applied only to the Robinsons. Once the Robinsons left the program the reasonable accommodation of 8 additional residents (total of 16) lapsed, and the new administrators at Daniels Academy were unaware of this fact. There are currently 13 young men at the home. This special meeting was called to decide how to proceed in this situation.
After discussion, it was determined that the new directors should apply for a reasonable accommodation through our adopted procedure. Council member Turner commented that the Town should stick to our procedure and have the new director reapply. Council member Bunker would like the applicants to come before the Council and give the Council correct information about the program and make their case for a reasonable accommodation. Mayor Duggin will approach the new administrators with the information that they will need to make their application.
5) DISCUSSION AND POSSIBLE ACTION REGARDING SUNDANCE RIDGE/SUNDANCE CANYON LICENSING/BUSINESS LICENSE (ADULT ADDICTION TREATMENT CENTER LOCATED ON LITTLE SWEDEN RD.)
Council member Bunker ran through the history of this business licensing process for the benefit of the Council members not familiar with the information. Application for a residential treatment center in the name of Sundance Ridge was made earlier this year by Stacey Peterson. As the process for licensing has proceeded, the original applicant seems to not be involved at this point. At least, the Town planner has not been able to contact her.
The Town has issued a business license to Sundance Ridge based on a permit for work to be completed issued by the Wasatch County Health Dept. for an upgrade in the septic system which services the residence. The work has not been completed, but Tracy Richardson of Wasatch County seems sure that Mr. Bill Fairbanks will complete the work in the next couple of months and is allowing the business to operate before the work is completed.
However, the business license was picked up by Mr. Boyd Hooper (not the original applicant), and he requested a name change on the license to Sundance Canyon. At this point, the Town is not sure who actually owns or will be operating this business and may require additional information from the applicant.
It was decided that Mayor Duggin will attempt to collect information about this business through the contact phone numbers the applicant has given the Town. If he is not satisfied with the information he receives, he will contact the Utah State licensing agency to voice his concerns.

Council member Bateman moved to adjourn. Council member Turner seconded the motion, and the Council voted unanimously to adjourn at 9:02 PM.
