SPECIAL Daniel Town Council Meeting

Quorum present: Mayor Michael Duggin, Council members Eric Bunker, Jon Blotter, and Chip Turner were all present at 6:03 PM when Mayor Duggin called the special meeting to order. Council member Kasey Bateman was absent. Recorder Merry Duggin was present to record the minutes.
Members of the public in attendance: Kim Norris and Shelly Bunker.
1) CONSIDERATION OF A PARAMETERS RESOLUTION AUTHORIZING NOTICE OF PUBLIC HEARING AND INTENT TO ISSUE BONDS OF NOT MORE THAN $170,000 OF SUBORDINATED WATER REVENUE BONDS; FIXING THE MAXIMUM AGGREGATE PRINCIPAL AMOUNT( not more than $170,000), MATURITY( not more than 32 years), INTEREST RATE (not to exceed.5% per annum), AND DISCOUNT OF THE BONDS (not to be sold at a price less than 99% of the total principal amount thereof); PROVIDING FOR THE RUNNING OF A CONTEST PERIOD; AUTHORIZING THE EXECUTION BY THE MAYOR OF A MASTER RESOLUTION AND OTHER DOCUMENTS NECESSARY FOR THE ISSUANCE OF THE BONDS; AND RELATED MATTERS.
Mayor Duggin read Daniel Resolution 2011-05-09. A discussion followed concerning some provisions of the resolution. It was explained that the resolution allowed the mayor authority to approve interest rates, principal amounts, terms, maturities and other changes provided such terms do not exceed the parameters set forth in this resolution. The word “maximize” was discussed as to whether it should be changed to “minimize” in the resolution. The address of the Town Clerk was changed from 1822 West 3000 South to 260 E. Teancum. The resolution also establishes a public hearing scheduled for May 25, 2011 at 6 PM in this same meeting room.
Council member Blotter moved to adopt Daniel Resolution 2011-05-09 setting parameters for the subordinated water revenue bonds. Council member Turner seconded the motion. The motion passed by the following vote: Turner, aye; Blotter, aye,; Duggin, aye; Bunker, nay.
After the vote, Mr. Kim Norris asked if Daniel Municipal Water funds could be used for General Fund purposes if the water system is profitable. Ms. Duggin will discuss this with our auditor, but generally water revenue must be used for the water system expenses.
2) Update of 2011 Utah State Legislature actions
Recorder Merry Duggin distributed a booklet from the League of Cities and Towns summarizing the bills before the 2011 Legislature followed by the League and discussing their impact. She suggested that the Council members might like to read the booklet and note any issues for the Town of Daniel.
3) Approval of minutes of May 2, 2011 meeting.
The minutes were not presented for approval at this meeting and will be considered at the next regularly scheduled meeting in June.
4) Committee reports: Planning, Daniel Municipal Water, Recorder’s Office
No committee reports were presented.
In general discussion, Mayor Duggin and the Council members spoke of the flooding situation in the Storm Haven area this month and wondered if the FEMA flood maps will prove to be accurate in predicting the flood prone areas.
Council member Bunker asked that the padlock recently installed on the water tap at his property be removed because he can’t close his gate. Mr. Bunker stated that he paid for the tap to be installed by Daniel Domestic Water Company, and the tap is installed in the wrong spot—on the wrong side of his water meter. Mr. Kim Norris replied that Daniel Municipal Water placed the padlock to try to control water usage so that we can have an accurate accounting of who is using water. He said that he would remove the lock right away.
The Council had a brief discussion concerning weeds: morning glory, yellow toadflax, and scotch thistle.
5) Adjourn
There being no further business, Council member Blotter moved to adjourn. Council member Turner seconded the motion. The Council voted unanimously to adjourn at 6:45.
