Daniel Planning Meeting Minutes

A quorum is present: Chairman Bunker and Commissioners Rawlings, Skinner, Bennett, Norris were present. Commissioners Weight and McAllister excused.

Members of the public in attendance: Victor Hansen, Mark Haroldsen, Ken Menlove, Robert Chatwin, Shelly Bunker. Secretary Keary Stephens.

1. Public Comments:

None

2. Robert Chatwin – 475 W 3000 S. Parcel #204380. He would like to address the council.

Mr. Chatwin is representing the person that owns this parcel and is wanting to get clarification on what is possible to do with this parcel. When it was purchased back in 1987 it was intended to be a buildable lot, but the codes have changed, and it is now not a buildable lot. Mr. Chatwin contends that it should be grandfathered in as a buildable lot. They have offers on it to build a home. They need to have documents that declare it as a buildable lot before the codes changed.

3. Mark Haroldsen – MD & Associates, Concept Zone Change. 3300 S HWY 40. Parcel # 20-4498
Mr. Haroldsen is requesting approval to change the zone from 300 ft to 400
ft.

Commissioner Norris moved to approve the Concept Zone Change to 400 ft. Commissioner Bennett Seconded it. Aye: Commissioners Norris, Bennett, Skinner. Nay: Commissioner Rawlings. Motion failed.

Commissioner Bennett moved to approve the Concept Zone Change to 400 ft with a Deed Restriction. Commissioner Rawlings seconded it. Vote was unanimous. Motion carried.

4. Minute Approval for March 17, 2021.

Commissioner Skinner moved to approve the minutes of March 17, 2021. Commissioner Norris seconded it. Vote was unanimous. Motion Carried.

5. Adjournment.

Commissioner Skinner moved to adjourn the meeting of May 19, 2021. Commissioner Norris seconded it.
