Quorum present: Mayor Michael Duggin, Council members Eric Bunker and Chip Turner. Council members Blotter and Bateman were not present. Recorder Merry Duggin was present to record the minutes.
Mayor Duggin called the regularly scheduled meeting to order at 5:30 PM.
Members of the public in attendance: Lambert Deegan, Keith Bates, Darwin McGuire, Gary Walton, Shelly Bunker, and Ryan Taylor.
1) PUBLIC COMMENT
Mr. Deegan asked about the amount of property tax collected by Town of Daniel. Recorder Merry Duggin responded that the town has collected approximately $50,000 of the $58,000 the Town had hoped to receive in property taxes.
2) APPROVAL OF MINUTES FOR FEBRUARY 1, 2010 MEETING
Council member Bunker moved to approve the minutes as presented. The motion was seconded by Council member Turner, and the council voted unanimously to approve the minutes.
3) CONSIDERATION OF DANIEL RESOLUTION 2010-03-01 IN SUPPORT AND IN PARTNERSHIP WITH THE 2010 CENSUS
Recorder Merry Duggin explained that the resolution was provided by the Complete Count Census Committee which was now requesting the Town Council to show its support of the 2010 Census by encouraging the citizens of Daniel to respond by mailing in their census forms promptly. After discussion concerning the benefits of responding to the Census, Council member Bunker moved to approve the resolution. Council member Turner seconded the motion, and the Council voted unanimously to approve the resolution in support of the Census and to encourage participation of the Town’s residents.
4) DANIEL MUNICIPAL WATER OPERATION ISSUES
Mayor Duggin opened the discussion by reminding those present that Daniel Municipal Water needs to follow through on some procedures concerning the Water department operation. Mr. Gary Walton was present to discuss licensing of the Rhino All Terrain Vehicle owned by Daniel Municipal Water. He wondered if the Town should upgrade the ATV to make it street legal. The Council determined that it would not be necessary to license the ATV as street legal for our purposes. The Council also decided to continue storage of the vehicle and DMW supplies at McGuire Storage for at least another 6 months.
Council member Blotter arrived at 5:55 PM.
Mayor Duggin moved on to the issue of DMW hook up fees and noted that the State legislature has made charging and collecting impact fees very difficult. Council member Bunker suggested that we might want to look into a “developmental agreement” which we might add to the DMW application for service. Mayor Duggin indicated that he would contact Rural Water for an opinion on this issue
Mr. Walton next informed the Council that some water users were not paying their bills promptly and have fallen behind even though they made a commitment for payment to the Town Council. Council member Bunker would like those people to come before the Town Council a second time and discuss the issue in a closed session and hopefully bring them into compliance with their agreement for payment. Some discussion occurred concerning shut off notices (if and when those should be sent, if the notice should state that the water user is responsible for any damage done by freezing as a result of the shut off, etc.) Mr. Walton agreed to work on bringing these people into compliance on payment.
Mayor Duggin suggested that Daniel Municipal Water should be paying the water manager a salary, and Council member Blotter agreed with Mayor Duggin and added that he hoped that someone had been assigned to write a job description for this position. Mr. Blotter also asked if Daniel Municipal Water has any situations in which multiple families are using the same hookup. Mr. Walton responded that one family is also using their hookup for a business in addition to residential, but the water usage is metered and subject to overage charges.
5) CDBG REPORT FROM MAYOR DUGGIN
Mayor Duggin informed the Council that Community Development Block Grant has awarded $190,000 to Town of Daniel for Daniel Municipal Water improvements in fiscal year 2010-11 bringing the total amount from CDBG to $508,000 over a two year period.
6) COMMITTEE REPORTS:
DANIEL MUNICIPAL WATER IMPROVEMENTS—Ryan Taylor reported that drilling on the new well has been completed at 810 feet. The well has an 8” casing and has screening placed at several depths which should provide enough gallons per minute to provide a complete replacement water source for the two springs if necessary in the future. The well is in development at this time and several tests must be performed before accurate data can be reported. Zimmerman Well Services has assumed the additional cost of drilling a second borehole. Additional cost of $215 per foot for a deeper well will be borne by Town of Daniel, but Mr. Taylor believes the additional money is well spent as the additional depth will give us a more productive well with less drawdown and less pumping cost in the long run.
PLANNING—Council member Bunker reported that the Planning Commission will be looking at our fencing law because Wasatch County has changed theirs.
7) RECORDER’S OFFICE REPORT
Recorder Merry Duggin reminded all present about the census to be mailed out within the next 2 weeks and encouraged everyone to respond promptly. She requested and received permission to schedule 3 public hearings (FEMA Flood ordinance, FY 2010 budget adjustment, and the required CDBG second public hearing) for the next Town Council meeting to be held on April 5, 2010.
8) ADJOURN
Council member Turner moved to adjourn. The motion seconded by Council member Bunker was passed by a unanimous vote. The Mayor adjourned the meeting at 7:25 PM.
