Meeting Minutes

Quorum Present: Council members: Mayor Chip Turner, Council members Eric Bunker, John Glodowski, Jon Blotter, and Stefanie Grady. Treasurer Sherri Price, and Clerk/Record Mary Snyder. Meeting was called to order at 6:00 PM.

Members of the public in attendance: Shelly Bunker, Cody Coleman, Scott Coleman, Bert Coleman, Pam Skinner, Mark McAllister, Gary Walton, Jamie McAllister, Robert Allen, Merry Duggin, and Samantha Moll.

1) Public Comment concerning issues (limit 2 minutes):
Pam Skinner requested updated maps be added to the website.

2) Disconnect Request- Nater Enterprises LLC
Council member Grady made a motion for a denial of the Nater Enterprises disconnect request based on the following items brought forth in the proceedings and public comment:
1- The request if granted could lead to hap hazard zoning and overlapping functions of government and could unnecessarily place a large burden on the tax payers
2- The culinary water authority has not responded, in detail or substance.
3- The property lies within a special service district.
4- There has been no application of services, outside of what the property has historically been provided.
5- The request is lacking, premature, analysis deficient.
6- The standard of review has not been met in my opinion, see Herriman City vs Draper City
7- Compelling, countervailing public interest would be jeopardized, if granted.
8- The property has been included in the General Plan, land use plan, zoning and ongoing long-range planning associated with overall community, sense of belonging municipality’s identity and future well-being.
9- This property lies contiguous to the Town and is in fact a main corridor, to the entrance of Daniel which has limited entrances, thereby cutting off access to guide planning.
10- The property is one of two entrances, into Daniel directly off Highway 40 corridor thus impeding the future long-range planning and the economic future of Daniel Town.
11- The Town has spent considerable time planning in cooperation with other municipalities and UDOT, to preserve the highway and has planned entrances accordingly with the public’s interest in mind. This request if granted, would affect, undo the cooperation agreement signed by these parties.
12- This disconnect would create an island of unincorporated land.
13- No map was obtained in the second application.
This motion was seconded by Council member Bunker. All members were in favor.
3) Disconnect Request- Mary Jo Coleman
Council member Glodowski motioned to deny the disconnect request of Mary Jo Coleman Trust based on the following items brought forth in the preceding hearings and public comment:
1- The request if granted could lead to hap hazard of Zoning and overlapping functions of the Government and could unnecessarily place a large burden on the Tax Payers.
2- The property immediately east is owned by the same Trust and is being served by Daniel Municipal Water Company and provides fire protection.
3- There has been no application for services, or Zoning outside of what has been historically provided to this parcel.
4- The request is lacking, premature, and analysis deficient.
5- The standard of review has not been met. See Herriman City vs Draper City.
6- Compelling, countervailing public interest would be jeopardize if granted.
7- The property has been included in the General Plan, Land Use Plan, Zoning and ongoing long-range planning associated with overall community sense of well-being.
8- This property lies within the Daniel Town at its incorporation date of 2006. This boundary was established by Wasatch County officials and County Council, with feasibility study conducted prior to incorporation and this disconnect may jeopardize this study and the feasibility of Daniel Town.
9- This property is currently located in the industrial zone and may inhibit future transportation corridors and service area, if request is granted.
10- The Town has spent considerable time and resources planning in cooperation with adjoining municipalities to keep continuity at the boundaries and this disconnect would inhibit these interlocal agreements and cooperation efforts.
11- This disconnect would enlarge and island of unincorporated land in Wasatch County.
This motion was seconded by Council member Grady. All members were in favor of the denial.
4) Moderate Income Housing Plan- Mountainland Association of Government (Robert Allen)
Robert Allen was present to discuss the Moderate Income Housing Plan.

5) BUSINESS LICENSE RENEWALS/APPLICATIONS:
There were no new applications or renewals.

6) PLANNING DEPARTMENT REPORTS, VIOLATIONS, & ENFORCEMENT

7) DANIEL MUNICIPAL WATER:
The Sanitary Survey is near 95% complete and have been working with Tracey from Wasatch County to complete.

The PRV vault located at the intersection of 3000 South and Daniels Road will begin updating starting early next week to repair issues.

9) APPROVAL OF COUNCIL MEETING MINUTES: October 1, 2018
Prior to approval of the October 1, 2018 meeting minutes, Council member Bunker stated that he would like to withdrawal his vote and reconsider a continuation of the approval of the General Plan.

Council member Glodowski motioned to reconsider the approved General Plan and continue this item, seconded by Council member Blotter. All members approved.

Council member Blotter motioned to approve the October 1, 2018 meeting minutes, seconded by Council member Grady. Motion passes.

10) RECORDERS OFFICE: WARRANTS APPROVAL, ANNOUNCEMENTS, ETC.
Council member Bunker motioned to approve the warrants to include Counterpoint Construction for $59,946.80 final billing for the 1200 West Water line project, seconded by Council member Grady. All members approve.

Council member Glodowski motioned to approve the tentative 2019 meeting schedule for the Council and Planning Commission based on room being available, seconded by Council member Grady. Motion passes.

At 8:04 PM, Council member Blotter motioned to go into closed session for litigation issues, seconded by Council member Grady. All member in favor.

11) CLOSED SESSION:
At 8:57 PM, Council member Grady motioned to end closed session and return to regular session, seconded by Council member Bunker. Motion passes.

Council member Grady motioned to hire a new Water Secretary, Shelley Bunker, seconded by Council member Glodowski. Mayor Tuner, Council members Grady, Glodowski and Blotter in favor. Council member Bunker abstained.

12) ADJOURN
At 8:59 PM, Council member Bunker made a motion to adjourn, seconded by Council member Grady. Motion passes.
