Daniel Planning Meeting Minutes

A quorum is present: Chairman Bunker and Commissioners Norris, Rawlings, Weight, Binkerd and Grose were present. Commissioner Skinner is excused.
Members of the public in attendance: Ryan Taylor of GDA Engineering, Brent Waterman, Stephanie Woolstenhulme, Mark and Jamie McAllister, Ryan Simpson, Adam Knight, Misty Giles, Tricia Steiner. Secretary Keary Stephens.
1. Public Comment concerning any issue not on the agenda
There were no public comments.
Chairman Bunker asked about going out of order, where we want to start.
2. 25 Home based business:
Commissioner Rawlings moved to adopt ordinance as is printed in this form. Commissioner Grose Seconded. The motion failed. Aye, Commissioners Grose and Rawlings; Nay, Commissioners Norris and Binkerd.
Discussion: Commissioner Rawlings noted that they talked about changing the wording on approval period from zoning to allowed use. Application: (1) adding per application. (9) Changing the words uses and rules to conditions. (10) Adding the word substantially. Bi- Annual renewal: changing the wording prior to renewal to at any time and the next paragraph adding the wording “with the advice and consent of the Council”.
Motion still stands with the changes that were discussed. Second still stands. Vote was unanimous, motion carried.
Letter of recommendation will be sent to the Daniel Town Council with the Chapter 8.25 Addendum.
3. McCallister Zone Change:
Commissioner Norris moved to continue this to the next agenda on July 19th, 2017. Commissioner Binkerd Seconded it.
Discussion: McAllisters are waiting on information from UDOT on access. Commissioner Grose wanted to know what they would do if turned down. They would just continue on with their continued use. Stephanie Woolstenhulme said that she thought that UDOT would not allow any more accesses and wanted a list of the continued use for this property.
Vote was unanimous. Motion carried.
4. Daniels Academy Remodel Application
Commissioner Weight requested a copy of the remodel application. Ryan Taylor presented that. It is really just adding a bathroom to the existing bedrooms.
Commissioner Norris moved to approve the Daniels Academy Remodel Application. Commissioner Weight Seconded it. Vote was unanimous and the motion carried.
5. Brady Karren Building Permit
Commissioner Weight moved to approve the Brady Karren Building Permit on the condition that Mr. Taylor is happy with the revisions. Commissioner Binkerd seconded it. Vote was unanimous and the motion carried.
6. David McCombs Building Permit
Mr. Taylor issued a letter to them and has not received a response back.
7. Dan Brown Building Permit
It has been issued and they are building.
8. Clyde Building Permit
They have started construction. Director Bunker has sent Mr. Taylor a letter concerning the issues that he found.
9. Three Farms – Small Scale Subdivision
Just to give you an update on this, they are digging the gas line now. We have a private road with a waterline. Does the town want to hold on to the waterline or do we want it to be a private line and they maintain it. Upon discussion it was decided it should belong to the town.
10. Planner Report
Everything on the report we have talked about. Hazmat litigation has problems; we won’t be passing this until Commissioner Bunker gets some answers.
11. Minute Approval for May 17, 2017
Commissioner Norris moved to approve the minutes of May 17, 2017. Commissioner Binkerd seconded it. Vote was unanimous. Motion carried.
Commissioner Binkerd moved to adjourn the meeting.
