Quorum present Mayor Michael Duggin, Council members Heather Bateman, Gary Walton, Eric Bunker.  Council member Jon Blotter was excused.

Also present were Planning Commissioner Kim Norris, Water board members Chris Anderson and Keith Bates, Water company secretary Joyce Anderson, Engineer Ryan Taylor, members of the public Renee Anderson, Darwin McGuire, Cathy Hinckley, Ron Hinckley, Blaine and Juanita Webb.

Recorder Merry Duggin was present to record the minutes.

Mayor Duggin brought the special meeting to order at 6 PM.

  1. DISCUSSION CONCERNING WEED CONTROL IN DANIEL TOWN AND POSSIBILITY OF AN INTERLOCAL AGREEMENT WITH WASATCH COUNTY FOR NOXIOUS WEED CONTROL

Council member Walton has had contact with the County Weed supervisor and explained that the County can’t hire enough people to do all the work necessary.  They would like to contract with weed sprayers, pay them directly, and bill the landowner.  They have the legal authority to attach these fees to property tax bills should the landowner refuse to pay in a timely manner.  Mayor Duggin showed concern about spraying private property, and he also noted that the proposed interlocal agreement would need some revision before he would approve signing it.  No action was taken on this agenda item.

  1. WEST DANIELS LAND ASSOCIATION RESPONSE TO TOWN OF DANIEL’S OFFER TO PURCHASE REAL PROPERTY FOR CONSTRUCTION OF NEW MUNICIPAL WATERWORKS SYSTEM.

West Daniels Land Association was not represented at this meeting though they had been informed of the meeting and invited to address the Town Council as per state statute requirements.

  1. CLOSED SESSION TO DISCUSS REAL PROPERTY ACQUISITION

No closed session was necessary.

  1. CONSIDERATION FOR ADOPTION OF A RESOLUTION BY TOWN OF DANIEL IN SUPPORT OF ACQUISITION OF REAL PROPERTY OWNED BY WEST DANIELS LAND ASSOCIATION UNDER POWER OF EMINENT DOMAIN FOR THE PURPOSE OF CONSTRUCTION OF NEW MUNICIPAL WATERWORKS SYSTEM.

Mayor Duggin read Daniel Resolution 2009-07-10 authorizing the use of the power of eminent domain by the Town Council, and also authorizing filing of a motion for immediate occupancy with the Fourth District Court.  There was no discussion, and Council member Walton moved to accept the resolution and move forward with an action of eminent domain.  The motion, after being seconded by Council member Bateman, passed by a unanimous vote of those council members present.  Mr. Blotter was absent.

  1. WATER COMPANY ISSUES. DISCUSSION AND POSSIBLE ADOPTION BY RESOLUTION OF NEW POLICY AND PROCEDURES, USER RATE STRUCTURE, OPERATING BUDGET, AND APPROVAL OF A LETTER TO BE MAILED TO CURRENT WATER USERS TO EXPLAIN THE NEW SYSTEM.

Mayor Duggin announced that Town of Daniel had been granted an additional $312,250 by the Department of Environmental Quality specifically to be used for line replacement.  He reminded the Council that the State would like us to initiate a tiered water rate structure that will provide enough income for the maintenance and operation of the water system and repayment of the bond debt.  Different rate structures were discussed, but no one plan was determined to be the best.  Mayor Duggin asked The Council to continue work on a proposed rate structure and ordinance to be adopted for the Water system.

Council member Walton opened a discussion on the proposed new water well that will receive our system overflow and also serve as a secondary water source for the Municipal water system.  Kim Norris discussed the possibility of building the new storage tank over the winter and noted that this might not be the best option.  Mayor Duggin stated that we should get our bids out and sign contracts as soon as possible.  We could start on the water line replacement as soon as we are funded.

  1. APPROVAL OF MINUTES FOR JULY 6, 2009 TOWN COUNCIL MEETING

Council member Bunker moved to approve the minutes as amended.  Council member Walton seconded the motion, and the motion passed by a unanimous vote.

  1. COMMITTEE REPORTS

Council member Bunker commended Blaine Webb for knocking down noxious weeds in the property across from his house on 3000 South.

  1. ADJOURN

Council member Bateman moved to adjourn.  The motion was seconded by Council member Bunker, and the motion passed by a unanimous vote.

Mayor Duggin adjourned the meeting at 6:50 PM.
